ADC Suspension Crisis: Court Throws Out Suit Against Senator Ireti Kingibe, Awards ₦20m Costs

The Federal High Court in Abuja has struck out a suit seeking to stop Senator Ireti Kingibe from participating in the activities of the African Democratic Congress following her alleged suspension from the party.


Delivering judgment on Friday, Justice Peter Lifu ruled that issues relating to discipline and suspension within a political party are internal matters that do not require judicial intervention. 


The suit was filed by some members of the ADC’s Wuse Ward Executive in Abuja, who had announced Kingibe’s suspension in March over alleged anti-party activities, gross misconduct, and disregard for the party’s constitution. The plaintiffs had asked the court to restrain the senator from presenting herself as a member of the ADC, attending party meetings, or carrying out any party-related functions. 


Justice Lifu, however, questioned why those who carried out the suspension were seeking judicial validation of their own action, insisting that if anyone had grounds to approach the court, it should have been the suspended party. 


The judge described the suit as frivolous, baseless, and lacking legal merit before striking it out. He subsequently imposed a ₦10 million fine on the plaintiffs and another ₦10 million against their counsel, bringing the total cost awarded in favour of Kingibe to ₦20 million. 


Kingibe, who represents the Federal Capital Territory in the Senate, has been involved in internal disagreements within the ADC ward structure since joining the party. Her legal team had argued that the matter was purely an internal party affair and that the plaintiffs failed to exhaust the party’s internal dispute resolution mechanisms before heading to court.
