Appeal Court Suspends Execution of Judgment Deregistering ADC, Accord, Others

The Court of Appeal has suspended the execution of the Federal High Court judgment that ordered the deregistration of the African Democratic Congress (ADC), Accord Party, Action Alliance (AA), Action Peoples Party (APP), and Zenith Labour Party (ZLP). 


In a strongly worded ruling, the appellate court criticized the conduct of the trial judge, Justice Peter Lifu, describing his actions as the “highest form of judicial impertinence.” The appellate court held that Justice Lifu proceeded to hear and determine the matter despite an earlier order of the Court of Appeal directing a stay of proceedings on the case. 


The panel of justices further stated that the judge exhibited what it termed “judicial rascality” by continuing with the case and issuing the controversial judgment while the matter was already pending before the appellate court. According to the court, such conduct amounted to a disregard for the authority and directives of a superior court. 


Consequently, the Court of Appeal granted an order staying the execution of the Federal High Court judgment, effectively halting any move by the Independent National Electoral Commission (INEC) to deregister the affected political parties pending the determination of the appeal. 


The development comes a day after Justice Lifu of the Federal High Court in Abuja ordered INEC to deregister the five political parties on the grounds that they allegedly failed to meet constitutional electoral performance requirements. The judgment had generated widespread controversy and strong opposition from the affected parties, particularly the ADC and Accord Party, which argued that the trial court acted in defiance of a subsisting Court of Appeal order. 


With the latest ruling, the affected parties retain their legal status and remain eligible to participate in electoral activities pending the final resolution of the case by the appellate court.
