Osun LG Battle: APC Rejects Court Verdict, Heads to Appeal Court

 The Osun State chapter of the All Progressives Congress (APC) has faulted the judgment of the Federal High Court in Osogbo which dismissed the suit filed by reinstated local government chairmen and councillors elected in the October 15, 2022 local government election, describing the verdict as a miscarriage of justice.

In a statement issued on Monday by the party's Director of Media and Information, Mogaji Kola Olabisi, the APC expressed dissatisfaction with the ruling delivered by Justice Adefunmilola A. Demi-Ajayi in Suit No. FHC/OS/CS/147/2025 and announced plans to challenge the judgment at the Court of Appeal.

According to the party, the suit was instituted in September 2025 by the reinstated local government officials, while several appeals arising from interlocutory rulings are already pending before the Court of Appeal, Abuja Division. The APC noted that the appellate court had heard arguments on June 3, 2026, and adjourned further proceedings to September 28, 2026.

The party argued that despite the pending appeals and a motion seeking a stay of proceedings before the appellate court, the trial court proceeded to deliver judgment, dismissing the suit and ruling that the tenure of the reinstated chairmen and councillors expired in October 2025.

The APC, however, maintained that the judgment effectively invalidates the local government election conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025, as well as the swearing-in of officials elected during the exercise.

The party urged members of the public to disregard what it described as misleading narratives surrounding the February 2025 election and insisted that the reinstated council officials would continue to discharge their duties while pursuing legal remedies.

The APC further disclosed that notices of appeal and motions for stay of execution have already been filed, stressing that no enforcement action can lawfully be taken against the chairmen and councillors until the appellate process is concluded.

The party also called on security agencies to maintain vigilance and ensure that the recent court decision does not lead to a breakdown of law and order in the state.

While appealing for calm among its members and supporters, the APC reaffirmed its commitment to pursuing all available legal options to protect what it described as its mandate at the grassroots level.
